• For Candidates: Participate in AI-powered conversational interviews that showcase your abilities beyond traditional resume screening
• For Organizations: Create, manage, and analyze conversational interviews to make more informed hiring decisions
• For Hiring Teams: Access insights, analytics, and candidate assessments based on conversational data

3. User Accounts and Access

Account Creation

• Access to our platform requires authentication through Google or Microsoft OAuth
• Enterprise users must be invited by Longwalk or an enterprise administrator
• You are responsible for maintaining the security of your account credentials
• You must provide accurate and complete information when creating your account

Acceptable Use

You agree to use our platform only for its intended purposes and in compliance with all applicable laws. You may not:

• Attempt to gain unauthorized access to any part of the platform
• Interfere with or disrupt the platform's operation or security
• Use the platform for any unlawful, harmful, or fraudulent purpose
• Attempt to reverse engineer, extract, or replicate our system prompts, proprietary conversation methodologies, assessment logic, platform workflows, or talent insight generation processes
• Share access credentials or allow unauthorized use of your account
• Attempt to bypass or circumvent our security controls, rate limiting, or access restrictions
• Send excessive requests or attempt to overwhelm our systems beyond normal usage patterns

4. Data and Privacy

Data Ownership and Usage

• Your Data: You retain ownership of the personal information you provide
• Conversation Data: Your conversation transcripts are shared with the inviting organization for hiring purposes
• Platform Improvement: We may use de-identified data and aggregate patterns to improve our platform
• Data Security: We implement industry-standard security measures including encryption, access controls, tenant isolation, comprehensive request protection, automated session management, and advanced threat prevention systems

5. Intellectual Property

Our Rights

• Longwalk and all related trademarks, service marks, and logos are our property
• The platform software, system prompts, conversation methodologies, assessment logic, and talent insight generation processes are protected by intellectual property laws
• All content, features, and functionality of the platform are owned by Longwalk

Your Rights

• Enterprise clients retain ownership of job descriptions, role requirements, and company-specific content
• Candidates retain ownership of their responses and personal information shared during conversations
• You grant us a limited license to use your content to provide our services and generate talent insights
• You may request data portability and deletion in accordance with our Privacy Policy

6. Service Availability and Support

Service Level

• We strive to maintain high availability and performance of our platform
• Scheduled maintenance and updates may temporarily affect service availability
• We provide reasonable technical support through our designated support channels

7. Limitations of Liability

To the fullest extent permitted by applicable law, Longwalk Insight shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, use, goodwill, or other intangible losses
• Damages resulting from unauthorized access to or alteration of your data
• Statements, conduct, or actions of any third party on the platform
• Any hiring decisions made by organizations using our platform

Our total liability for any claims arising from or related to these terms or our services shall not exceed the amount paid by you (if any) for accessing our services in the twelve months preceding the claim.

8. Disclaimers

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Merchantability, fitness for a particular purpose, or non-infringement
• Uninterrupted, secure, or error-free operation
• Accuracy, reliability, or completeness of content or AI-generated insights

9. Termination

By You

You may discontinue using our services at any time. If you wish to delete your account or data, please contact our admin team.

By Us

We may suspend or terminate your access to our services at any time for violations of these terms, illegal activity, or to protect the security and integrity of our platform.

Effect of Termination

• Your right to access and use the platform will cease immediately
• Data retention will be governed by our Privacy Policy and applicable laws
• Provisions regarding intellectual property, disclaimers, and limitations of liability will survive termination

These Terms of Service are governed by and construed in accordance with the laws of the United States and the state where Longwalk is incorporated, without regard to conflict of law principles.
